General Terms and Conditions Bátur B.V. 

Article 1 - Definitions
1.1 Seller: the natural or legal person who offers products to consumers both remotely and in physical locations.
1.2 Buyer: the natural person who is not acting in the exercise of a profession or business and enters into a (remote) agreement with the seller.
1.3 Distance Agreement: an agreement concluded within the framework of a system organized by the seller for the remote sale of products and/or services, whereby exclusive use is made of one or more means of remote communication up to and including the moment of the conclusion of the agreement.

Article 3 - Applicability
3.1 These general terms and conditions apply to every offer from the seller and to every distance agreement concluded between the seller and the buyer.
3.2 Before the distance agreement is concluded, the text of these general terms and conditions will be made available to the buyer. If this is not reasonably possible, the seller will indicate before the distance agreement is concluded how the general terms and conditions can be inspected at the seller’s premises and that they will be sent free of charge to the buyer as soon as possible upon request.
3.3 An agreement between the buyer and the seller is concluded by the acceptance by the seller of an order (the offer) placed by the buyer on or via the website. The agreement is concluded at the moment the buyer receives a confirmation from the seller via electronic means.
3.4 All products displayed on the website are offered subject to availability. The seller is not liable for typographical errors, product descriptions, or apparent mistakes on the website.

Article 4 - The Offer
4.1 The offer contains a complete and accurate description of the products and/or services offered. The description is sufficiently detailed to enable a proper assessment of the offer by the buyer.
4.2 The seller reserves the right to reject an order placed by the buyer for the following reasons:

  • If products are no longer available;
  • In case of apparent errors or mistakes in the price or description of the products;
  • If there are technical issues that prevent the processing of the order;
  • If the total value of the order exceeds €2,500;
  • If the information provided by the buyer is incorrect or incomplete;
  • If payment is not received within the agreed term;
  • If the buyer has previously failed to fulfill payment or acceptance obligations;
  • In case of suspected fraud or misuse.

Article 5 - Delivery Method and Delivery Dates
5.1 Delivery is carried out by a carrier designated by the seller. In case of a failed delivery attempt, the order may be delivered to a neighboring address or at a pick-up point of the carrier. The carrier will inform the buyer of such delivery.
5.2 After the conclusion of the agreement, the seller will deliver the products as soon as possible but no later than 30 days, unless a different delivery period has been agreed upon. If delivery is delayed, the buyer will be informed as soon as possible and has the right to cancel the agreement at no cost.
5.3 The risk of damage and/or loss of products rests with the seller until the moment of delivery to the buyer or a pre-designated representative made known to the seller, unless expressly agreed otherwise.

Article 6 - Buyer’s Obligations during the Reflection Period
6.1 During the reflection period of fourteen (14) days, the buyer will handle the product and packaging with care. The product will only be unpacked or used to the extent necessary to assess the nature, characteristics, and functioning of the product. If the buyer exercises their right of withdrawal, they must return the product with all delivered accessories and, if reasonably possible, in the original condition and packaging, in accordance with the reasonable and clear instructions provided by the seller.

Article 7 - Costs in Case of Withdrawal
7.1 The buyer has the right to withdraw from the agreement within fourteen (14) days without providing any reason.
7.2 The withdrawal period commences on the day after the buyer, or a third party designated by the buyer, has received the product.
7.3 The buyer must inform the seller of their intention to withdraw from the agreement within the withdrawal period by using the model withdrawal form or by any other unequivocal statement.
7.4 The costs of returning the product are to be borne by the buyer.
7.5 The seller will refund the purchase price within 14 days after receiving the returned product. The seller may withhold the refund until the product has been received or until the buyer has provided proof of return shipment, whichever is earlier.

Article 8 - The Price
8.1 During the validity period stated in the offer, the prices of the products and/or services offered will not be increased, except for price changes resulting from changes in VAT rates or other legal charges.
8.2 The prices mentioned in the offer of products or services include VAT.

Article 9 - Conformity and Warranty
9.1 The seller guarantees that the products and/or services comply with the agreement, the specifications stated in the offer, and the reasonable requirements of reliability and/or usability.
9.2 Any guarantee provided by the seller, manufacturer, or importer does not affect the legal rights and claims that the buyer may assert against the seller under the agreement.

Article 10 - Payment
10.1 Unless otherwise agreed, the amounts owed by the buyer must be paid within 14 days after the commencement of the reflection period.
10.2 The buyer is obliged to immediately report any inaccuracies in payment details provided or stated to the seller.

Article 11 - Complaints Procedure
11.1 The seller has a sufficiently publicized complaints procedure and handles complaints in accordance with this complaints procedure.
11.2 Complaints about the performance of the agreement must be submitted to the seller within a reasonable time, fully and clearly described, after the buyer has discovered the defects. Complaints submitted will be answered within 14 days from the date of receipt.

Article 12 - Disputes
12.1 All agreements between the seller and the buyer to which these general terms and conditions relate are exclusively governed by Dutch law.
12.2 Disputes between the buyer and the seller may be submitted to the competent court in the district where the seller is established.

Article 13 - Additional or Deviating Provisions
13.1 Additional or deviating provisions from these general terms and conditions may not be to the detriment of the buyer and must be recorded in writing or in such a way that they can be stored by the buyer in an accessible manner on a durable data carrier.
